On Nov. 18, U.S. Citizenship & Immigration Services published a Final Rule to improve several aspects of certain employment-based immigrant programs as well as work visa programs. To many employees who have started their employment-based immigrant visa petitions and are in E3, H1, L1 and O1 visa status, the Final Rule provides flexibility in areas of portability and work authorization. These new rules took effect on Jan. 17.
Among the most significant changes in the Final Rule are the following:
