Superior Court sides with Guam Shipyard in case on mass layoff

Employees have lost their case in the Superior Court of Guam against Guam Industrial Services, which does business as Guam Shipyard. In an order issued on Dec. 30, Chief Judge Frances M. Tydingco-Gatewood granted Guam Shipyard’s motion of dismissal.

On Jan. 31, 2014, Russ Carlberg, Roel D. Dacasin, Reynaldo S. Galvez, Delmario R. Cortez and Gary Chang filed a class action complaint against Guam Shipyard and its president, Matthews Pothen, alleging the company had violated the Worker Adjustment and Retraining Notification Act and was guilty of gross negligence when it laid off hundreds of employees in 2013 after . . .
